This agreement is concluded between the Internet portal CityScale - https://www.cityscale.com.ua, herefrom - PORTAL, and PORTAL user, herefrom - USER.
The moment of full and unconditional adoption of the terms of this agreement by the USER is the fact of transition to payment for paid data providing on the conditions of this agreement at prices indicated on the PORTAL at the time of transition to payment.
The user agrees to pay for paid data, and the PORTAL undertakes to put such data after a successful payment.
The data payment is performed through the PORTAL or via a bill(invoce) for individual orders.
Paid data is provided by the PORTAL only after a successful payment, through sending a download link for those data.
A payment is considered successful after a funds, equal to the price of the service, transferred to the PORTAL's account, that is confirmed the payment system LiqPay.
In order to send a paid data download link, the USER should be registered on the PORTAL or provide a valid email address.
A paid data providing is considered complete when a download is detected by the PORTAL.
When a paid data providing is complete, payment for it is NOT returning.
Returning or refusal of a payment for a paid data providing before providing is complete is the termination of this agreement.
Data provided by the PORTAL "AS-IS".
Before making a payment the USER can preview a limited version of a paid data with no charge by using a "PREVIEW" function of the PORTAL, and make a free choice, which data to pay for a providing.
Any proposals or claims of the USER regarding the data content are accepted by the PORTAL voluntary, and can not be the reason for returning the payment after providing is complete.
Is case when the USER violated this agreement terms, the PORTAL is exempted from fulfilling obligations under this agreement.
The USER is obligated to post a link to the PORTAL as a source of data when publishing data provided by the PORTAL, parts of such data or publications(works) created using such data.
The USER has no right to use the PORTAL's data bypassing conditions of data providing without an explicit PORTAL consent. Otherwise, the USER carries full responsibility for violating the terms of this agreement in accordance with the current laws of Ukraine and International laws.
The PORTAL is not responsible for any USER actions, that involve a data of the PORTAL.
In case of occurrence of irresistible force("force majeure"), the PORTAL and the USER are exempted from the fulfilling of the terms of this agreement. Under the circumstances of irresistible force("force majeure") for the purposes of this agreement are considered events that have an emergency, unpredictable character that excludes or objectively prevent the fulfilling of this agreement, and occurrence of which the PORTAL and the UXER could not predict and prevent in reasonable ways or which recognized as such by laws of Ukraine.
The PORTAL and the USER put a maximum effort to solve any contradictions only by negotiations.
